LIABILITY RELEASE

I have been well advised and thoroughly informed of the inherent hazards of skin diving and scuba diving. Further, I understand that diving with compressed air involves certain risks and injuries can occur which require treatment in a recompression chamber. I also understand that the open water trips maybe at a site that is remote, either by time or distance or both, from such a recompression chamber.
I personally assume all risk in the connection with the said diving trips for any harm, injury or damage that may befall me as a result of my participation in the diving trips, whether foreseen or unforeseen, and I still wish to proceed with the diving trips in spite of the possible absence of a recompression chamber in proximity of the dive site. I understand and agree that If in the unfortunate event that dives are missed or dive sites are not reached due to weather conditions or other unforeseeable changes or technical issues, Carlton Fleet will not refund or compensation. This includes also all Marine Park Fees and Port fees, not refundable
I understand and agree that neither the DIVEMASTER, INSTRUCTOR, CREW, MANAGER, TECHNICAL MANAGER, OWNER OF M/Y Carlton or Carlton Queen located in Sharm el Sheikh, Sinai, Egypt, may be held liable in any occurrence in connection with these diving trips that may result in injury, death or other damages to me or my family heirs or assigns, and in consideration of being allowed to enroll in these diving trips , including all risks connected therewith, whether foreseen or unforeseen, and further to save and hold harmless said persons from any claim by me or my family, estate, heirs or assigns arising out of my participation in these diving trips.
I further state that I am of lawful age and legally competent to sign this affirmation and release or that I have acquired the written consent of my parents or guardians; that I understand that the terms therein are contractual and not a recital; and that I have signed this document of my own free will.
It is my intention, by this instrument, to exempt and release the DIVEMASTER, INSTRUCTOR, CREW, MANAGER, TECHNICAL MANAGER, OWNER of M/Y Carlton or Carlton Queen from all liability whatsoever for personal injury, property damage or wrongful death caused by negligence. I have fully informed myself of the contents of this affirmation and release by reading it before I signed it.
Medical Declaration I hereby confirm that I have no medical history which could be considered incompatible with scuba diving. Medical Statement to fill on board - the information I have provided about my medical history is accurate to the best of my knowledge. I agree to accept responsibility for omissions regarding my failure to disclose any existing or past health condition. I have fully informed myself of the contents of this affirmation and release by reading it before I signed it.
Tanks I have examined the tanks on board and found all in good working order and certify that I am properly trained in its use. I further hold harmless DIVEMASTER, INSTRUCTOR, CREW, MANAGER, Rental Company, TECHNICAL MANAGER, OWNER of M/Y Carlton or Carlton Queen, and their agents from any accident occurring during the use of the said equipment. I bind myself to treat the items of equipment entrusted to me with care. In case of said damage and in case of loss, I will make compensation in amount of the damage incurred or the value when new + freight + custom duty. I have been fully aware that this area is under environmental protection and that offenders are liable to prosecution by the LAW 102 of 1933.

Diving Insurance: it is my responsibility to cover all aspects of my scuba/non scuba/kite surf holiday.
Safety on board: I have been informed regarding Safety on board. Location of Oxygen, Life Rafts, Life Wests and Rafts, Location of Fire extinguisher Emergency Exits and procedures and Medical Box. I have been advised that any use of Medication from this box i take on my own risk. I have been informed regarding Environmental law and dive Regulations and hereby confirm to follow the rules.
We will not be liable or pay you compensation or refund payment if our contractual obligations to you are affected by “Events Beyond our Control”. We will not be liable for any additional expenses incurred by you in connection with your booking through another supplier such as insurance, flights, hotels, transfers or ground arrangements including car hire. For the purposes of these Booking Conditions, Events Beyond our Control means any event beyond our or our supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination, the act of any government or other national or local authority including port or river authorities, industrial dispute, labour strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, epidemics and pandemics, unavoidable technical problems with transport and all similar events outside our or the supplier(s) concerned,s control.
I understand that I must show a valid diving certification, log book and diving insurance and sign a medical declaration and an the exemption from liability. In the interest of safety, a dive computer, a marker buoy and a diving lamp must be carried on every dive. To participate in a safari I must have an Advanced Open Water Diver or equivalent diving certificate and have logged at least 50 dives for southern route and 30 dives for northern route. Participation in all dives, especially the wreck dives, depends on the diving qualification and the experience of each guest. Strong currents must be considered. Crossings in southern areas during the Night. The dive sites listed in the route descriptions are examples, if you have special requests, just let your dive guide know. All route destinations are subject to approval by the Egyptian authorities, the coast guard and the port police. All routes are subject to change and may change at short notice due to weather conditions or official orders. The final course of the live aboard will be determined in consultation with the group on board. The final decision is made by the captain and diving guide, with the safety of guests always being the top priority! If dives are missed or diving locations are not approached due to weather conditions or other unpredictable changes, Carlton Fleet will not issue a refund or compensation, this includes technical defects as well as all Marine Park fees and Port fees. Embarkation port depends on the schedule and route. We reserve the right to accommodate guests the first or last night at the resort, the final port of arrival / departure is the responsibility of the owner and may change depending on the booking / route. We reserve the right to change Boats if the need arises. Strong current are common and must be taken into account. Night dives and snorkeling are prohibited on the Brothers Islands Daedalus & Elphinestone Reef. Brother Island no overnight permitted.
